Doncaster solicitor acts in wind farm deal

Doncaster solicitor’ firm Taylor Bracewell has helped a local landowner in granting a lease of land in Marr, just outside Doncaster, on which a new 4 turbine wind farm will be constructed, commencing work in Autumn 2011.

The deal is part of a project by BANKS Renewables, part of The Banks Group, to build 2 wind farms in Yorkshire, in which they will be investing £21m. Supported by investment from The Co-operative Bank, it is said to be the largest investment in the renewables market that The Co-op has made to date.

With the demand for ‘clean’ energy growing, the landowner was keen to see his land used for this purpose. He knew the deal would not be straight-forward of course, so contacted Paul Hawkes, commercial property specialist at Taylor Bracewell. Such land transactions are often complex, and this was no exception: the tenant’s requirements changed, as they do; additional land was required; a listed wall had to be dealt with and road junctions had to be altered. However, what was unusual here was that the pace of change in technology meant that the turbine specifications kept changing too – keeping Paul on his toes! He took it all in his stride, however, and negotiated a long lease on behalf of his client, albeit with some unusual rental conditions.

Paul said “I am delighted to be involved in a project of this nature, as the clean energy sector is is environmentally sound and is a boost to the whole of society. However, the deal also threw up interesting issues in terms of rent structures, tenant obligations and the logistics of physically getting the masts to the site – unusual and really good to get my teeth into”.
